Terms & Conditions Agreement

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING OUR SERVICES.
Your access to and use of the Services indicates your acceptance of these Terms, which form a binding agreement between you and Rahhal. If you do not agree with these Terms, please refrain from accessing or using the Services.
These Terms replace any previous agreements or arrangements between you and Rahhal. Following a notification to you, Rahhal reserves the right to terminate these Terms or any Services related to you at any time and for any reason.
Supplemental terms may apply to specific Services and will be integrated into these Terms. In case of any conflict, the supplemental terms will take precedence.
Rahhal may update these Terms periodically. Changes will take effect upon posting at this location. Your continued use of the Services after any updates signifies your acceptance of the revised Terms.
1. THE SERVICES
1.1 The Services consist of a technology platform that enables users to arrange and schedule vehicle towing services through independent third-party providers (referred to as "3rd Party Providers").
1.2 You acknowledge that Rahhal does not directly provide towing services; all towing services are rendered by independent 3rd Party Providers who are not affiliated with Rahhal.
1.3 Rahhal does not provide services to countries sanctioned by OFAC.
2. USE OF THE RAHHAL SERVICE
2.1 USER ACCOUNT
2.1.1 To access most features of the Services, you must download the Rahhal app and create and maintain an active personal user account (the “Account”) through the app.
2.1.2 Account registration requires you to provide certain personal details, such as your name, email, and mobile phone number.
2.1.3 You agree to keep your Account information accurate, complete, and current. Failing to do so may prevent you from accessing the Services.
2.1.4 You are responsible for all activities that occur under your Account and must keep your username and password confidential.
2.2 USER CONDUCT
2.2.1 You may not permit others to use your Account, nor allow individuals under 18 to receive towing services from 3rd Party Providers unless accompanied by you. Transferring your Account to another person or entity is not permitted. You agree to comply with all applicable laws while using the Services.
2.2.2 You must not engage in activities that cause nuisance, annoyance, or property damage to any 3rd Party Provider or other parties. You may be required to provide proof of identity to access the Services.
2.3 USER-PROVIDED CONTENT
2.3.1 Rahhal may allow you to submit, upload, or publish content (“User Content”). You retain ownership of your User Content but represent that you have the necessary rights to submit it.
2.3.2 You agree not to submit User Content that is offensive, defamatory, or violates any laws. Rahhal reserves the right to review, monitor, and remove User Content at its discretion.
3. PAYMENT
3.1 Using the Services may incur charges for services or goods received from 3rd Party Providers (“Charges”). After you receive services, Rahhal will facilitate your payment on behalf of the 3rd Party Provider.
3.2 Charges will include applicable taxes and are non-refundable unless stated otherwise by Rahhal.
3.3 All Charges are due immediately, and payment will be processed using the preferred method selected in your Account. A receipt will be sent to your email.
3.4 Rahhal accepts Visa and MasterCard debit and credit cards, and transactions will be conducted in United Arab Emirates Dirham (AED).
3.5 Rahhal reserves the right to adjust Charges at its discretion. While we strive to inform you of any changes, you are responsible for any Charges incurred under your Account.
3.6 While gratuities to 3rd Party Providers are appreciated, you are not obligated to provide them.
3.7 After receiving services, you may rate your experience and provide feedback about your 3rd Party Provider. Please ensure your feedback is constructive and respectful.
4. CANCELLATION POLICY
You may cancel your requested services within 30 minutes of your request. Cancellations can occur in two situations: (i) if the driver has not yet accepted the service, you can cancel via the Rahhal application; (ii) if the driver has accepted the service, you must contact customer support to confirm your cancellation.
5. PRIVACY
5.1 Rahhal values your privacy. This notice outlines how we collect, use, disclose, retain, and protect your personal information.
5.2 We do not store, sell, share, rent, or lease your credit/debit card information to any third parties.
5.3 We take reasonable precautions to protect your information but cannot guarantee the security of data transmitted over the internet
5.4 Rahhal is not responsible for the privacy practices of external websites linked within our Services. If you share information with third parties, their privacy policies will apply.
5.5 We encourage you to review our Terms and Privacy Policy regularly for updates.
6. RESTRICTIONS ON SERVICE
You agree not to: (i) remove any proprietary notices; (ii) reproduce or modify the Services; (iii) decompile or reverse engineer the Services; (iv) overload or disrupt the Services; or (v) gain unauthorized access to any part of the Services.
7. OWNERSHIP
The Services and all associated rights remain the property of Rahhal. These Terms do not grant you any rights to use Rahhal’s name, logos, or trademarks.
8. DISCLAIMER
The Services are provided on an “As Is” and “As Available” basis. Rahhal disclaims all warranties not expressly stated in these Terms.
9. LIMITATION OF LIABILITY
Rahhal is not liable for indirect, incidental, special, exemplary, or consequential damages. In no event shall Rahhal’s total liability exceed the amount you paid for the Services.
10. INDEMNITY
You agree to indemnify Rahhal and its affiliates from any claims arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights.
11. TERM AND TERMINATION
11.1 This Agreement begins upon your acceptance and continues until terminated as outlined herein.
11.2 Either party may terminate this Agreement for a material breach or you may terminate by deleting your Account.
11.3 Rahhal may terminate these Terms or any Services at any time for any reason.
12. NOTICES
Notices from Rahhal will be sent to the email associated with your Account. Notices from you can be sent through the “Contact Us” section on our website.
13. JURISDICTION
This Agreement is governed by the laws of the UAE. Both parties submit to the exclusive jurisdiction of the UAE Courts.
14. ADDITIONAL TERMS
14.1 User Feedback: You grant Rahhal the right to use any feedback or suggestions you provide regarding the Services.
14.2 Force Majeure: Rahhal is not liable for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, acts of war, or labor disputes.
14.3 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
14.4 Entire Agreement: These Terms constitute the entire agreement between you and Rahhal regarding the use of the Services.
